Welcome. These Terms set out the rules for using eigenkor.com, which is operated by eigenKOR. Please read them before you use the site.

Using this site means you accept these Terms. If any part of them does not work for you, the answer is simply not to use the site.

These Terms govern your use of this website. Nothing more.

They are not the contract under which we perform work. If we provide services to you, that engagement runs on a separate written agreement signed by both of us, covering scope, fees, deliverables, ownership of work product, confidentiality, and how either side ends it. Where that agreement and these Terms disagree, that agreement wins for the work it covers.

Sending us a message through the contact form does not create an engagement. Neither does our reply.

Our Privacy Policy sets out what we collect when you use this site, why we collect it, who else is involved, and what you can ask us to do about it. It forms part of these Terms.

Everything on this site — the writing, research, design, code, logos, and the eigenKOR name — belongs to eigenKOR or to whoever licensed it to us. Using the site does not give you any ownership of it, and we keep every right we have not expressly granted here.

Citing our research. We publish original measurement, and we would like it used. You may quote our findings and figures, in commercial work included, provided you attribute them to eigenKOR and link to the page you took them from. What you may not do is reproduce a study wholesale, or present our work as your own.

Parts of this site may rely on tools built by other companies, and we link to pages we do not run.

We do not control any of it. We are not answerable for what those services do, for what those pages say, for how they handle your information, or for any loss you suffer through using them or relying on them. If something there matters to you, read that company’s own terms and privacy policy — ours cannot speak for them.

Use the site for its intended purpose: learning what we do and getting in touch.

Do not attempt to break, overload, or gain unauthorised access to the site or anything connected to it. Do not scrape it in a way that degrades it for others. Do not use the contact form to send unlawful, threatening, or deliberately false material.

We may withdraw or suspend access to the site, in whole or in part, at any time and without advance notice. We would normally only do this in response to misuse or a technical necessity.

You can end these Terms whenever you like by not using the site.

Some parts of this document are meant to outlast your use of the site, and they do: section 3 (our content), section 7 (no warranties), section 9 (limit of liability), and section 10 (governing law).

The site is offered as it stands and as it happens to be available at the time. We do not promise it will be uninterrupted, error-free, secure, or accurate, and we do not promise that any result described on it will be achieved for you.

To the fullest extent permitted by law, eigenKOR — together with every party that supplies us — makes no warranty of any kind about this site, whether express or implied, and specifically makes no implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.

Anything you take from this site, you take at your own judgement and risk.

The studies, statistics, and market findings published here reflect measurements we took at a stated point in time, using methods we describe. They are research, not a forecast and not a promise of outcome. Markets move and search systems change. Do not treat a published figure as a guarantee of what will happen for your business.

To the fullest extent the law allows, eigenKOR will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunity, arising from your use of this site — whether or not we were warned such losses were possible.

Where liability cannot be excluded, our total liability for all claims connected to this site is limited to one hundred US dollars (US$100).

Nothing here limits liability that the law does not permit us to limit, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence. This section governs your use of the website; it does not alter the liability terms of any signed services agreement between us.

Texas law governs these Terms and your use of this site, without applying its conflict-of-law rules.

Disputes arising from these Terms or from your use of the site are to be brought in the state and federal courts located in Harris County, Texas. You agree those courts have personal jurisdiction over you, and you give up any argument that they are an inconvenient place to hear the matter.

Where the law where you live gives you a right that cannot be signed away, this section does not take it from you.

We may revise these Terms. When we do, we will update the date at the top and post the new version here.

If a revision is material, we will say so — by notice on the site, by email, or both — and we will aim to give at least 30 days before it takes effect. If you do not accept a change, stop using the site before the change takes effect. Continuing to use it afterwards means the new version applies to you.

If a court finds any part of these Terms unenforceable, that part is trimmed to the minimum extent necessary and the rest continues to apply.

If we do not enforce something straight away, we have not given up the right to enforce it later.

These Terms, together with the Privacy Policy, are the entire agreement between us regarding your use of this website.
